Commercial Terms

1. Acceptance of Commercial Terms

By accessing or using FantasyAI ("Service", "we", "us", "our"), you agree to be bound by these Commercial Terms ("Terms"). If you do not accept these Terms, you may not use our Service. These Terms constitute a legally binding agreement between you and CMTStudios, a Danish company registered at Centrumsgaden 145A, Padborg, Denmark.

2. Age Requirements and Age Verification

You must be at least 18 years old to use this Service. By using our Service, you represent and warrant that:

  • You are at least 18 years of age
  • You have the legal capacity to enter into these Terms
  • You will comply with all applicable laws and regulations

For access to NSFW (Not Safe For Work) content, we require age verification through date of birth confirmation. We reserve the right to request additional verification and to suspend accounts that cannot verify their age.

3. Account Registration and Security

To use certain features of our Service, you must register an account. You agree to:

  • Provide accurate, current and complete information during registration
  • Maintain and update your account information to keep it accurate and current
  • Maintain the security of your password and account
  • Notify us immediately of any unauthorized use of your account
  • Accept responsibility for all activities that occur under your account

You may not share your account information with others. You are responsible for maintaining the confidentiality of your account.

4. AI Generation Service

Our Service uses artificial intelligence to generate images based on text prompts you provide. You acknowledge and agree that:

  • Generated images are created by AI systems and do not always produce expected results
  • AI-generated content may contain inaccuracies, biases or unexpected elements
  • The quality and accuracy of generated images depends on the prompts and parameters you provide
  • We do not guarantee that generated images will meet your specific requirements or expectations
  • AI generation involves computational resources and processing time

5. Content Policy and Acceptable Use

You agree not to use our Service to generate or upload content that:

  • Depicts minors in sexual contexts or in any sexually explicit manner
  • Contains material about sexual abuse of children (CSAM) or any form of child exploitation
  • Violates applicable laws and regulations
  • Infringes intellectual property rights, including copyright, trademarks or patents
  • Promotes or depicts non-consensual sexual content
  • Contains hate speech, racism, discrimination or promotes violence
  • Depicts real persons without their consent (deepfakes)
  • Contains defamatory, libelous or harassing content
  • Promotes illegal activities or provides instructions for illegal acts

We reserve the right to review, moderate and remove any content that violates this policy. Violations may result in immediate account termination and reporting to law enforcement authorities where required by law.

6. Credits and Payments

Our Service operates on a credit-based system and subscription model:

  • Credits: Credits are consumed for each image generation. Credits cannot be refunded once used.
  • Subscriptions: Subscription plans provide recurring access to credits and features. Subscriptions renew automatically unless cancelled.
  • Payment Processing: Payments are processed securely through third-party providers (Stripe, Mollie, PayPal, Razorpay, Paddle, LemonSqueezy). We do not store your payment card information.
  • Refunds: Credits and subscriptions are generally non-refundable unless required by law or in case of service failure on our part.
  • Pricing: We reserve the right to change prices and plans with 30 days notice for existing subscribers.

7. Right of Withdrawal (14-Day Right of Withdrawal)

In accordance with Danish legislation, as a consumer you have a 14-day right of withdrawal for distance selling (online purchases):

  • You have the right to withdraw from your purchase without giving any reason within 14 days from the date of purchase
  • The withdrawal period expires after 14 days from the day you entered into the contract
  • To exercise your right of withdrawal, you must give us a clear statement of your decision to withdraw (e.g. by email)
  • We will refund all payments received from you without undue delay and no later than 14 days from the day on which we receive your notice of withdrawal

Exceptions to the right of withdrawal: The right of withdrawal does not apply to:

  • Delivery of digital content not supplied on a tangible medium, if you have expressly agreed that delivery can begin before the withdrawal period expires, and you have acknowledged that you will lose your right of withdrawal
  • Services where the price has been agreed or paid in full, and you have expressly requested that performance begin before the withdrawal period expires

When you purchase credits or subscriptions, you agree that delivery of digital content can begin before the withdrawal period expires, and you acknowledge that you will lose your right of withdrawal when delivery has begun.

8. Warranty Rights (Two-Year Warranty)

In accordance with Danish Sale of Goods Act, you have a two-year warranty on digital services:

  • If the service does not meet the agreement, you have the right to demand remedy or replacement
  • If remedy is not possible, you have the right to a proportionate price reduction or refund
  • The burden of proof lies with us for the first 12 months after delivery (presumption rule)
  • After 12 months, you as a consumer must prove that the defect was present at delivery

9. Intellectual Property

Ownership of intellectual property is as follows:

  • Your Content: You retain ownership of text prompts and other content you provide to our Service.
  • Generated Images: You own the images you generate, subject to the licenses of the underlying AI models. We make no claim of ownership over your generated content.
  • Service IP: All software, algorithms, interfaces and technology powering our Service remain our exclusive property.
  • AI Model Licenses: Generated images may be subject to the license terms of the AI models used (e.g. Creative Commons, open-source licenses).

You grant us a limited, non-exclusive license to store, process and display your generated images solely for the purpose of providing the Service and as necessary for technical operations.

10. User Responsibilities and Warranties

You represent and warrant that:

  • Your use of our Service complies with all applicable laws and regulations
  • You have all necessary rights, permissions and consents for any content you provide
  • You will not use our Service for illegal or prohibited purposes
  • You will not attempt to circumvent technical measures or security controls
  • You will not use automated tools to abuse our Service or generate excessive requests
  • You will not reverse-engineer, decompile or attempt to extract our AI models or algorithms

11. Privacy and Data Protection

Your use of our Service is also subject to our Privacy Policy, which explains how we collect, use and protect your personal data in compliance with GDPR, the Data Protection Act and the EU AI Act. Please review our Privacy Policy carefully.

By using our Service, you consent to the collection and processing of your personal data as described in our Privacy Policy.

12. Account Suspension and Termination

We reserve the right to suspend or terminate your account and access to our Service at our sole discretion, without prior notice, for any reason including but not limited to:

  • Breach of these Terms or our Content Policy
  • Suspicious or fraudulent activity
  • Abuse of our Service or resources
  • Failure to pay fees or charges
  • Provision of false or inaccurate information
  • Violation of applicable laws and regulations

Upon termination, your right to use the Service ceases immediately. We may also delete your account information and content in accordance with our data retention policies and applicable law.

13. Limitation of Liability

THE SERVICE IS PROVIDED "AS IS" AND "AS AVAILABLE" WITHOUT ANY WARRANTY OF ANY KIND, EITHER EXPRESS OR IMPLIED. TO THE MAXIMUM EXTENT PERMITTED BY DANISH LAW:

  • We make no warranties regarding the accuracy, reliability or quality of generated images
  • We do not guarantee uninterrupted or error-free operation of the Service
  • We are not liable for any loss or damage resulting from your use of the Service
  • We are not liable for any content generated by our AI systems

WE SHALL UNDER NO CIRCUMSTANCES BE LIABLE FOR ANY INDIRECT, INCIDENTAL, SPECIAL, CONSEQUENTIAL OR PUNITIVE DAMAGES, INCLUDING BUT NOT LIMITED TO LOSS OF PROFITS, DATA, USE OR OTHER INTANGIBLE LOSSES, RESULTING FROM OR RELATING TO YOUR USE OF THE SERVICE.

14. Indemnification

You agree to indemnify, defend and hold harmless CMTStudios and its affiliates, officers, directors, employees and agents from any claim, damage, liability, cost and expense (including reasonable attorneys' fees) arising from or relating to your use of the Service, your breach of these Terms or your violation of third-party rights.

15. Governing Law and Dispute Resolution

These Terms shall be governed by and construed in accordance with Danish law, without regard to its conflict of law provisions. Any dispute arising from or relating to these Terms shall be resolved through:

  • Good faith negotiations between the parties
  • If unresolved, through the Danish courts

Notwithstanding the foregoing, you also have the right to lodge a complaint with the Danish Data Protection Agency (Datatilsynet) regarding data protection matters.

16. Changes to Terms

We reserve the right to modify these Terms at any time. We will notify you of material changes by posting the updated Terms on our website and/or sending you an email notification. Your continued use of the Service after such changes constitutes acceptance of the updated Terms.

17. Severability

If any provision of these Terms is found to be unenforceable or invalid, that provision will be limited or eliminated to the minimum extent necessary so that the remaining Terms remain in full force and effect.

18. Entire Agreement

These Terms, together with our Privacy Policy and other legal notices published on our Service, constitute the entire agreement between you and CMTStudios regarding the use of the Service.
